This privacy policy explains which personal data Travly V.O.F., trading as Jobfox (‘Jobfox’, ‘we’, ‘us’), processes, for which purposes, and what rights you have. This policy applies to the website jobfox.nl and to the Jobfox platform.

1. Who is Jobfox

Jobfox is a trade name of Travly V.O.F., established in Rijen, registered with the Dutch Chamber of Commerce (KvK) under number 75173832. If you have questions about this privacy policy or about how we process your personal data, you can contact us at hello@jobfox.nl.

Depending on your relationship with Jobfox, we act either as a controller — meaning we determine the purpose and means of the processing ourselves — or as a processor, meaning we process data on behalf of and under the instructions of an employer using the Jobfox platform. The sections below indicate which role applies for each group.

2. Visitors of jobfox.nl

We currently do not use any analytics tools, tracking cookies, or advertising networks on our website. Visiting jobfox.nl therefore does not result in any cookies being placed or your behaviour being tracked.

If you contact us by email, we process the information you provide — such as your name, email address, and the content of your message — solely to respond to your query. We do not retain this information for longer than necessary to handle your query, and we do not use it for marketing purposes.

For this processing, Jobfox is the controller. The legal basis is our legitimate interest in being able to respond to visitor queries, or the performance of a (prospective) contract.

3. Users of the Jobfox platform (employers and their staff)

Employers who use the Jobfox platform, and the staff who have access on behalf of the employer — for example recruiters or HR employees, referred to as ‘Users’ — provide us with information to create and use an account, such as name, email address, job title, and organisation details.

We process this information to:

• provide access to the platform and manage accounts;
• provide support;
• comply with our administrative and tax obligations, for example invoicing.

For this processing, Jobfox is the controller. The legal basis is the performance of the contract with the employer, and for administrative records, our legal obligation to retain them for the statutory period (generally seven years for tax records in the Netherlands).

4. Candidates

Employers use the Jobfox platform to follow up with candidates after their job application through automated, AI-based communication via WhatsApp (the ‘AI follow-up’). In this context, Jobfox processes personal data of candidates.

Division of roles

The employer with whom you applied is the controller for your data: the employer determines which vacancy you are being followed up for, which questions are asked during the AI follow-up, which criteria are used to qualify you, and what happens with the outcome — for example inviting you for an interview, rejecting your application, or contacting you directly for more information. Jobfox is a processor: we provide the technology the employer uses for this, and we process your data on the employer's behalf and instructions.

What data

Depending on the employer's application process, this may include: your name, email address, phone number, postal code/city, the role and sector you applied for, education level, work experience, availability, motivation, and the content of your WhatsApp conversations during the AI follow-up, including the outcome of the screening.

WhatsApp and AI

The AI follow-up runs through the employer's own WhatsApp Business Account and through Anthropic, the provider of the Claude AI technology, using an API connection in the employer's name. This means your messages are also processed by Meta (WhatsApp) and by Anthropic, under those parties' own terms towards the employer.

Use for improving Jobfox

Jobfox may review and analyse the content of conversations conducted through the AI follow-up, including any personal data they contain, in order to maintain and secure the platform and to improve the quality of the AI follow-up. Access to this is limited to a small number of Jobfox employees. We do not use this data to build profiles of individual candidates, for marketing purposes, or to train, improve, or validate third-party AI models, including models offered by Anthropic.

Retention period

The employer is responsible for determining how long your data is retained, and for deleting or anonymising it in a timely manner. As an additional safeguard, Jobfox automatically anonymises your identifying data — such as name, email address, phone number, and postal code — after three months of inactivity in your record, regardless of whether the employer has already taken action.

5. Your rights and deletion of data

Under the GDPR, you have a number of rights, including the right to access, rectify, erase, restrict the processing of, and object to the processing of your personal data, as well as the right to data portability.

Are you a candidate?

To exercise these rights, please contact the employer with whom you applied — they are the controller for your data. If you contact Jobfox directly, we will forward your request to the relevant employer and inform you accordingly.

Are you a platform User, or a visitor of our website?

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl).

6. Other parties that process data

To operate the Jobfox platform, we use a limited number of other parties that act as processors on our behalf:

In addition, candidate data, as described in section 4, is also processed by Meta (WhatsApp) and by Anthropic (Claude API), under the employer's own account and the employer's own agreements with those parties. These parties are not processors of Jobfox.

7. Changes to this policy and contact

We may update this privacy policy from time to time, for example when the platform is expanded or when laws and regulations require it. The date of the last update is shown at the bottom of this page.
